Official Rules

THE FOLLOWING PROMOTION IS INTENDED ONLY FOR LEGAL RESIDENTS IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA (EXCLUDING OVERSEAS MILITARY INSTALLATIONS, PUERTO RICO AND OTHER U.S. TERRITORIES) AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT PROCEED WITH THIS SWEEPSTAKES IF YOU ARE NOT A RESIDENT IN THE 50 UNITED STATES OR IF YOU ARE LOCATED IN AN OVERSEAS MILITARY INSTALLATION, PUERTO RICO, OTHER U.S. TERRITORIES OR FOREIGN TERRITORIES. 1. GENERAL: These are the official rules, (the "Official Rules") for the Fuel Up for the Holidays Sweepstakes presented by BP gasoline with Invigorate (the "Sweepstakes"). The Sweepstakes is administered and sponsored by ABC Radio Networks Assets, L.L.C. ( "ESPN Radio or "Administrator/Sponsor") 261 Madison Avenue, New York, NY 10016, and presented by BP Gasoline, Inc ("Presenter").

2. NO PURCHASE NECESSARY: Entrants do not have to purchase a product to enter or win. A purchase does not increase your chances of winning. Open to legal residents of the United States and the District of Columbia (EXCLUDING WITHOUT LIMITATION, THOSE RESIDENTS IF LOCATED IN AN OVERSEAS MILITARY INSTALLATION, PUERTO RICO, OTHER U.S. TERRITORIES OR FOREIGN TERRITORIES) who are 21 years of age or older who have a valid email address and Internet access prior to the beginning of the Promotional Period (as defined below.) Offer void where prohibited by law, taxed, or otherwise restricted. All federal, state and local laws and regulations apply. The Sweepstakes begins at 3:00 PM Eastern Time (ET) on November 9, 2009 and ends at 11:59 PM ET on December 6, 2009 (the "Promotional Period"). For purposes of these Official Rules, all times are Eastern Time (ET).

3. HOW TO ENTER: There are two (2) way to participate during the Promotion Period: 1) Online: Visit ESPNradio.com, vote in the poll, complete the ESPN.com member sign-in and complete and submit the online entry form in accordance with the instructions provided to receive one (1) entry. To enter the Sweepstakes at ESPNRadio.com, an entrant must be a member of espn.com or one of our family of sites (ABC.com, ABCNEWS.com, Disney Online, EXPN.com, Family.com, Movies.com). Registration is free at all of the above sites. If the entrant is not a member, the entrant can register by logging on to ESPNRadio.com, clicking on the link for the Sweepstakes, clicking on the registration link, and following the instructions. Entrants will be asked to provide their name, e-mail address, zip code, birth date, gender and to select a password. Entrants will also be asked to consent to receive promotional e-mails from the Administrator/Sponsor. Consenting to receive promotional e-mails is optional and does not have to be agreed to in order to become a member or win. Entrants may also be asked to answer survey questions or to consent to receive promotional e-mails from the Presenter. Answering survey questions or consenting to receive promotional e-mails is optional and does not have to be agreed to in order to be eligible to enter or win the Sweepstakes.

2) Text: Text message the keyword "TRYBP" to 73776 using a wireless handset that is SMS enabled. Once you send the text message, you will receive a bounceback message confirming one (1) sweepstakes entry. Your cellular phone must be capable of sending and receiving text messages to participate via this method. NOTE: Standard data and text messaging charges apply. See your wireless service provider for specific text messaging instructions and pricing plan details.

Limit one (1) entry per person, per phone number and per valid e-mail address per day. Entries received from any person, phone number or e-mail address in excess of the stated daily limitation will be void. The name of the "authorized account holder" associated with any given e-mail address will be deemed to be the entrant and must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, an online service provider, or another organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Proof (to Sponsor's satisfaction) of being the authorized account holder may be required by Sponsor. If a winner is a text message sender, prize will be awarded to the primary individual named on the wireless account from which the text message is sent. In the event a winning account selected is a joint account, a total of one (1) prize will be awarded in the names of the joint account holders.

Released Parties are not responsible for providing any Internet access or cellular phone service, or for lost, stolen, incomplete, late, damaged, or misdirected entries, text messages, email messages; failures or malfunctions of phones (including wireless phones/handsets), phone lines or telephone systems or other communications malfunctions, cellular equipment tower, telephone systems, wireless service problems; interrupted or unavailable network, server or other connections including those through www.espn.com; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrant's or any other person's computer related to or resulting from participation in this Sweepstakes; printing, typographical or other errors appearing within these Official Rules or in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, network, human, technical, electronic, printing, typographical or otherwise, including, without limitation, errors that may occur in connection with the administration of the Sweepstakes, the processing of entries or registrations, the announcement of the prizes or in any other Sweepstakes-related materials. The use of automated entry or similar devices or other means to subvert the entry process is prohibited and entries through such prohibited means are void. By entering this Sweepstakes, entrants give their express permission to be contacted by Sponsor by telephone, e-mail and/or postal mail for Sweepstakes purposes only.

E-MAIL CHANGE OF ADDRESS POLICY: It is the sole responsibility of the entrant to notify the Administrator/Sponsor if the entrant's e-mail address changes. To do so, click on the help link at the bottom of any ESPN.com page, then click on the Change Personal Information link and follow the instructions.

Administrator/Sponsor, Presenter, and their agencies and their respective parent, affiliate, and subsidiary companies, and their respective officers, directors, employees, representatives, and agents are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Administrator/Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. Administrator/Sponsor, Presenter, and their respective parent, affiliate, and subsidiary companies, and their respective officers, directors, employees, representatives, and agents assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Web-site, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation in or downloading any materials from this Sweepstakes. Entries generated by robots or scripts are considered to be a direct violation of these Official Rules and will result in immediate disqualification of any and all associated entries. Administrator/Sponsor and Presenter are not responsible for any typographical or other printing errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in the printing of posting of the offer or in these Official Rules, the selection or announcement of the winners, or the distribution of any prizes.

4. WINNER SELECTION/ PRIZE DRAWING(S): One (1) Grand Prize Winner and fifteen (15) Runner-Up Winners will be selected one or about December 9, 2009 in a random drawing from among all eligible entries received. Potential winners will be notified by phone and/or e-mail. The Administrator/Sponsor will conduct the drawing. By participating, entrant agrees to be bound by the Official Rules and the decisions of the Administrator/Sponsor, which shall be final and binding in all respects. In case of dispute as to identity of the winner, such entry will be declared made by the registered user of the e-mail account, and if the prize is won, and such registered user is a valid entrant, the prize will be awarded to such registered user. The "registered user" is the natural person to whom an e-mail address is assigned by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All entries will be deemed to have been made by the registered user of the e-mail address.

5. PRIZE(S)/APPROXIMATE RETAIL VALUE/ODDS OF WINNING:

One (1) Grand Prize: One Grand Prize winner will receive $2,080 in BP Gasoline gift cards. Fifteen (15) Runner-Up Prizes: Fifteen winners will each receive a $100 BP Gasoline gift card.

Approx Retail Value of All Prizes: $3,580

Odds of winning depend on the number of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER AND WILL BE BASED ON THE ACTUAL RETAIL VALUE OF THE PRIZE.

Winner is solely responsible for any and all expenses relative to participation in Sweepstakes (including acceptance of prize) not specified herein. Administrator will not replace any lost or stolen prize items. Prize is not transferable. The prize is awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). All entries will be declared made by the registered user of the e-mail address.

6. ADDITIONAL ELIGIBILITY REQUIREMENTS: Officers, directors, representatives, employees or agents of Administrator/Sponsor, Presenter and their respective parent, affiliate, subsidiary and successor companies, their advertising/promotional agencies, and the members of their immediate families or those persons living in the same household of anyone so employed are ineligible to enter or win. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.

7. CONDITIONS OF PARTICIPATION FOR ALL WINNERS: If a potential winner does not respond to notification e-mail within five (5) days of its transmission, or should an e-mail, after up to three (3) attempts, be returned as undeliverable, the potential winner will be disqualified. Winner must respond with information confirming they meet the eligibility requirements for this sweepstakes. Grand Prize Winner will be required to sign and return an Affidavit of Eligibility/Liability/Publicity Release, and W-9 form within five (5) days of the date specified on the prize notification. In the event of non-compliance with these requirements, any potential winner may be disqualified and the prize awarded to an alternate, time permitting. Runner-Up winners must complete and return an email notification verifying their eligibility under these Official Rules. The Sponsor has up to three months to deliver prizes. Prize returned as undeliverable or otherwise not claimed after being sent will be forfeited. Administrator/Sponsor reserves the right, in its sole discretion to cancel, terminate, or suspend this Sweepstakes should viruses, bugs, unauthorized human intervention, fraud, technical failure or other causes corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes. In such event, the prize winners will be selected by random drawing from all eligible entries received up to the time of such cancellation, termination or suspension. Administrator/Sponsor also reserves the right, in its sole discretion, to cancel or terminate this Sweepstakes due to earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, war or armed conflict (whether or not officially declared).

8. RELEASE, PUBLICITY: By participating, entrants release, indemnify and hold harmless Administrator/Sponsor, Presenter and their respective parent, affiliate, subsidiary and successor companies, their advertising/promotional agencies, and the employees, officers, directors and agents of any of the above organizations ("Released Parties") from any and all liability for any injuries, losses, or damages of any kind caused by participation in the Sweepstakes or the acceptance, possession or use/misuse of a prize or participation in any prize-related activities. Except as otherwise prohibited by law, by accepting any prize winner grants permission to use his/her name, address, likeness, photograph, voice, and statements by Administrator/Sponsor, Presenter and their respective parent companies, affiliates, subsidiaries, and advertising/promotional agencies for advertising/publicity purposes, in any media worldwide, in perpetuity, without further compensation, unless otherwise prohibited by law. The previous sentence does not apply to residents of Tennessee. Released Parties are not responsible for the cancellation, postponement or delay of the Sweepstakes.
