Eligibility: The KingsfordR Charcoal On the Grill Promotion ("Sweepstakes") is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older as of 8/25/08. Employees, officers, directors, agents and representatives of ESPN/Starwave Partners d/b/a ESPN Internet Venture ("Sponsor"), The Kingsford Products Company ("Presenter"), Project Support Team, Inc. ("P/S/T") ("Administrator") and each of their respective parent companies, subsidiaries, affiliates, advertising/promotion/fulfillment agencies, anyone else connected with the production and distribution of this Sweepstakes (hereafter, collectively "Released Parties") and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in their same household, whether or not related, are not eligible to enter or win. Sweepstakes is void where prohibited by law. To enter the Sweepstakes, entrant must be a member of ESPN.com or one of our family of sites (ABC.com, ABCNEWS.com, Disney Online, EXPN.com, Family.com, Movies.com). Registration is free. If entrant is not a member, entrant may register by clicking on the link as indicated on the Sweepstakes entry page and following the instructions. Entrant will be asked to provide his or her name, physical address, email address, telephone number, birth date, gender and to select a password. Entrant will also be asked to consent to receive promotional emails. Consenting to receive promotional emails is optional and does not have to be agreed to in order to become a member or to win a prize. As a member, entrant may enter the Sweepstakes by first logging in to the system with entrant's current username and password. Entrant may then be asked to answer survey questions or to consent to receive promotional emails from the Sponsor. Answering survey questions or consenting to receive promotional emails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes or to win a prize. Entrants are responsible for insuring that all contact information is up-to-date and accurate.
How To Participate: Visit www.ESPN.com between 12:00:00 PM Eastern Time ("ET") on 8/25/08 and 12:00:00 PM ET on 11/2/08 ("Promotion Period"), complete the espn.com member sign-in, search for keywords "Kingsford," "Tailgate," "Grill," OR "Grilling," and fully complete and submit the online entry form in accordance with the instructions provided to receive one (1) Sweepstakes entry. In addition, entrants will have the opportunity to earn one (1) bonus Sweepstakes entry when they submit a college football-themed or tailgate-themed question. There is a limit of two (2) entries per person/e-mail address per day. Additional entries from any one person/e-mail address during any given day of this Sweepstakes will be void. The name of the "authorized account holder" associated with any given e-mail address will be deemed to be the entrant and must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, an online service provider, or another organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Proof (to Sponsor's satisfaction) of being the authorized account holder may be required by Sponsor. Released Parties are not responsible for lost, incomplete, late, damaged, or misdirected entries or points, email messages; failures or malfunctions of phones, phone lines or telephone systems or other communications malfunctions; interrupted or unavailable network, server or other connections including those through www.espn.com; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrant's or any other person's computer related to or resulting from participation in this Sweepstakes; printing or other errors appearing within these Official Rules or in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic or otherwise. The use of automated entry or similar devices as specifically set forth above is prohibited and entries/points earned through such prohibited devices are void. Weekly Prize Winner Selection: A total of thirty (30) Weekly Prize winners (three per week) will be selected in a random drawing conducted on or about 11/5/08 from among all eligible entries received during each given week of the Promotion Period. For the purpose of this Sweepstakes, each week will begin on a Monday and end the following Sunday. Entries received for one (1) Weekly Prize drawing will not carry forward to or be included in subsequent Weekly Prize drawings. Weekly Prize winners will be notified by email, telephone, overnight delivery and/or mail. Limit one (1) Weekly Prize per person, family or household. Odds of winning a Weekly Prize will depend on the total number of eligible entries received for the applicable weekly drawing.
Grand & First Prize Winner Selection: The Potential Grand & First Prize winners will be selected in a random drawing conducted on or about 11/5/08 from among all eligible entries received. Odds of winning the Grand or First Prize will depend on the number of eligible entries received during the Promotion Period. Grand & First Prize winners will be notified by email, telephone, overnight delivery and/or mail.
Prizes: (1) Grand Prize: A Bowl Game Tailgate for eight (8) (winner plus seven (7) guests) in Orlando, FL between 12/31/08 and 1/2/09. Trip includes round-trip coach air transportation for eight (8) from major U.S. gateway airport nearest winner's primary residence in the U.S., 2-night accommodations at a house, a pre-game tailgate party for eight (8) (excluding alcoholic beverages), ground transfers to/from the airport/house/game and admission for winner and seven (7) guests to the game. Approximate Retail Value ("ARV"): $7,045. If the Grand Prize winner chooses not to take allotted number of guests, then the guest elements will be forfeited and the remaining elements shall constitute full satisfaction of the Grand Prize. Grand Prize winner and his/her guests airfare not to exceed a maximum amount of $4,800. Grand Prize winner and his/her guests agree to abide by all terms and conditions imposed by the house management company and to conduct themselves in a tasteful and courteous manner during their stay, demonstrating respect for the property and its neighbors. Winner and his/her guests further agree that, upon their departure from the property, aside from requiring standard cleaning services, the property will be left in the same condition/state that it was in upon their arrival and that they will be responsible for any costs of clean-up or repair should they fail to do so. (1) First Prize: A NASCAR Pit BBQ for winner plus one (1) guest at the Homestead-Miami Speedway between 11/17/08 and 11/18/08. Trip includes round-trip coach air transportation for two (2) from major U.S. gateway airport nearest winner's primary residence in the U.S., 2-night standard double occupancy hotel accommodations (one (1) room), admission for winner and one (1) guest to the race on 11/17/08 & 11/18/08 including food and beverages (excluding alcoholic beverages) and ground transfers to/from the destination airport/hotel/race. ARV: $2,050. If the First Prize winner chooses not to take a guest, then the guest elements will be forfeited and the remaining elements shall constitute full satisfaction of the First Prize. Sponsor reserves the right to remove or to deny entry to winner and/or guests if he/she engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at game or race. Actual value of and trip prizes may vary depending on each winner's city of departure. If the actual value of trip prize is less than the stated ARV, the difference will not be awarded. Travel, accommodations and other arrangements to be determined by Sponsor. Trip winners and their respective guests are responsible for obtaining any/all necessary documents (including but not limited to valid photo I.D.) prior to departure. Other travel/accommodation restrictions may apply. Trips must be taken on dates and times designated by Sponsor or the respective prize will be forfeited in its entirety and may be awarded to an alternate winner. All minors in their states of residence must be accompanied by an adult at all times. No responsibility is assumed by Sponsors for canceled, delayed, suspended or rescheduled event. Sponsor reserves the right to assign seating. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance of destination, as determined by Sponsor in its sole discretion, and to award no additional compensation in such event. Sponsor is not responsible for travel delays. (30) Weekly Prizes (three (3) per week): Prize Pack consisting of one (1) charcoal grill, a season of KingsfordR Charcoal awarded as nine (9) coupons for KingsfordR Charcoal, each valued at $6.00, an assortment of KingsfordR Grill accessories (selected by Sponsor, one (1) ESPN Grill Station, one (1) $50 ESPN Gift Card, one ESPN MVP Chair & one (1) ESPN Cookbook. ARV: $226. Prizes are awarded "as is" without warranty or guarantee either express or implied by Sponsor. Any and all warranties and/or guarantees (if any) shall be subject to the manufacturer's terms therefore (each winner agrees to look solely to such manufacturer for any such warranty and/or guarantee, if any). Terms, conditions & restrictions on coupons and gift card may apply. Total ARV of all prizes: $15,875.
Miscellaneous: All costs, including federal, state and local taxes and other expenses not specifically identified as included in the prize, are solely the responsibility of the individual winner. No transfer, assignment, cash redemption or substitution of prizes (or portion of prize) except by Sponsor due to prize unavailability and then for a prize (or applicable portion of prize) of equal or greater value as determined by Sponsor. Potential Grand & First Prize winners will be required and Weekly Prize winners may be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within two (2) days of issuance of notification. Grand & First Prize traveling companions (or, if a minor, his/her parent or legal guardian) will be required to sign and return a Liability Release and (where legal) Publicity Release prior to the issuance of travel documents. Non-compliance with the foregoing may result in disqualification and awarding of prize to an alternate winner for the drawing at issue. If any prize notification letter or prize is returned as undeliverable, winner will be disqualified and an alternate winner may be selected for the drawing at issue at Sponsor's discretion. Designation of winners is subject to verification of the Affidavit/Release. All drawings will be conducted by Administrator, an independent judging organization whose decisions are final and binding in all matters relating to this Sweepstakes. By participating, entrants agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees may use (unless prohibited by law) their name, voice, city/state of residence, photograph and/or likeness for advertising and/or trade and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification, and 2.) Released Parties and their designees and assigns shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize (including any travel or activity related thereto) or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate this Sweepstakes (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor, including but not limited to war or armed conflict (whether or not officially declared), labor controversy or threat thereof, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and, in the event of termination or suspension, at its discretion, select winners from among eligible, non-suspect entries/points received for the drawing at issue as of the date of the event requiring such termination or suspension. Sponsor reserves the right to conduct a background check of any and all records of the Grand & First Prize winner/travel companions, including without limitation, civil and criminal court records and police reports. To the extent necessary under law, Grand & First Prize winner/travel companions shall authorize this background check. Sponsor may also take all steps necessary to corroborate any information provided to Sponsor by Grand & First Prize winner/travel companions in his/her interview. In that regard, Grand & First Prize winner/travel companions will be obligated to provide necessary contacts and information so that Sponsor may conduct such investigation. Sponsor reserves the right (at its sole discretion) to disqualify Grand & First Prize winner/travel companions from any prize element, based on the background check.
Email Change of Address Policy: It is solely the responsibility of the entrant to notify Sponsor if his or her email address changes. To do so, click on the help link at the bottom of any ESPN.com page, then click on the Change Personal Information link and follow the instructions.
Disputes/Choice of Law: Except where prohibited, each entrant agrees that: (i) all issues and questions concerning these Official Rules shall be governed by New York law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and (B) filed only in the state or federal courts situated in New York County, New York state, i.e., Manhattan, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Privacy: Personally identifiable information that is submitted by entrants as part of this Sweepstakes will be used to administer the Sweepstakes, select prize winners and fulfill prizes, and will be treated in accordance with Sponsor's privacy policy accessible on its website at www.espn.com.
