Eligibility: Player of the Month Presented by Kia ("Sweepstakes") is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older and the age of majority as of date of entry. Employees, officers, directors, agents and representatives of ESPN Internet Ventures ("Sponsor"), Kia Motors America, Inc. ("Presenter"), Project Support Team, Inc. ("P/S/T" and/or "Administrator"), the National Basketball Association ("NBA") and its member teams, NBA Media Ventures, LLC, NBA Properties, Inc., (collectively, the entities named in the preceding three clauses will be referred to as the "NBA Entities") and each of their respective parent companies, subsidiaries, affiliates, owners, distributors, retailers, agents, assignees, advertising/ promotion/ fulfillment agencies, anyone else connected with the production and distribution of this Sweepstakes (hereafter "Released Parties") and their immediate families (spouse, partner, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in their same household, whether or not related, are not eligible to enter or win. Sweepstakes is void where prohibited by law. To enter the Sweepstakes, entrant must be a member of ESPN.com or one of our family of sites (e.g., ABC.com, ABCNEWS.com, Disney Online, ESPN.com/High-School and Family.com). Registration is free. If entrant is not a member, entrant may register by clicking on the link as indicated on the Sweepstakes entry page and following the instructions. During registration, entrant will be asked to provide his or her name, physical address, zip code, telephone number, email address, birth date, gender, to select a user name and password and accept the Terms of Use on ESPN.com. Those who are already members of ESPN.com will be asked to enter their account information (email address or user name, and password) to enter. Entrant may then be asked to answer survey questions or to consent to receive promotional emails from the Sponsor and/or Presenter (and/or Presenter's dealers or affiliates), and to having Sponsor share entrant's personal information with Presenter for such promotional purposes. Answering survey questions or consenting to receive promotional emails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes or to win a prize, nor does answering survey questions or consenting to receive promotional emails increase an entrant's chances of winning. As a member, entrant may enter the Sweepstakes by logging in to the system with entrant's current username and password. To Enter: This Sweepstakes consists of four (4) entry periods (each a "Voting Period") between 1/2/13 and 4/19/13. There are two (2) ways to participate between 12:00 PM Eastern Time ("ET") on 1/2/13 through 11:59 AM ET on 4/19/13 ("Promotion Period"): 1) Online: Visit ESPN.com, search for keyword "Kia", complete the ESPN.com member sign-in as described above and fully complete and submit the online entry form (including your vote for the "Player of the Month" in both the East & West Conference) to receive one (1) Sweepstakes entry in the applicable Voting Period. 2) Wireless Application Protocol ("WAP"): During the Promotion Period, visit http://wap.gotvnetworks.com/espn_kia_2013 using your WAP enabled wireless device, complete the ESPN.com member sign-in as described above and fully complete and submit the online entry form (including your vote for the "Player of the Month" in both the East & West Conference) to receive one (1) Sweepstakes entry in the applicable Voting Period. NOTE: Results of vote will have no impact on entry or your chances of winning. You may be charged for WAP service according to the terms of your service agreement with your service provider. You must be a wireless service subscriber with a WAP enabled wireless device to enter via this method. Normal airtime and carrier charges may apply and will be billed on your wireless phone bill or deducted from your pre-paid balance. Each wireless carrier's rate plan may vary, and you should contact your wireless carrier for information on rate plans and charges relating to your participation in this Sweepstakes. The name of the "authorized account holder" associated with any given e-mail address will be deemed to be the entrant provided he/she meets all other eligibility requirements and must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, an online service provider, or another organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Proof (to Sponsor's and Presenter's satisfaction) of being the authorized account holder may be required by Sponsor and/or Presenter. If a winner is a wireless service subscriber, prize will be awarded to the primary individual named on the wireless account from which the wireless service was accessed. In the event a winning account selected is a joint account, a total of one (1) prize will be awarded in the names of the joint account holders. Sponsor is not responsible for lost, incomplete, late, damaged, or misdirected entries or email messages; failures or malfunctions of phones, phone lines or telephone systems or other communications malfunctions; interrupted or unavailable network, server or other connections including those through www.espn.com; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrant's or any other person's computer related to or resulting from participation in this Sweepstakes; printing or other errors appearing within these Official Rules or in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic or otherwise. The use of automated entry or similar devices is prohibited and entries through such prohibited devices are void. Grand Prize Winner Selection: One (1) potential Grand Prize winner will be selected in a random drawing conducted on or about 4/24/13 from among all eligible entries received by Administrator, an independent judging organization whose decisions will be final and binding in all matters relating to this Sweepstakes. Odds of winning a Grand Prize will depend on the number of eligible entries received during the Promotion Period. Potential winner will be notified by telephone, overnight delivery and/or mail in Sponsor's sole discretion.
First & Second Prize Winner Selection: Potential First and Second Prize winners will be selected in four (4) individual random drawings from among all eligible entries received for the applicable Voting Period (as defined below). In each random drawing, one (1) potential First Prize winner and five (5) potential Second Prize winners will be selected, subject to verification, for a total of four (4) potential First Prize winners and twenty (20) potential Second Prize winners over the course of the Sweepstakes. Non-winning entries received for one (1) Voting Period will carry forward to subsequent Voting Periods and be eligible to be included in subsequent drawings. First and Second Prize winners remain eligible to be included in the drawing for the Grand Prize. Potential First & Second Prize winners will be notified by telephone, overnight delivery and/or mail. Odds of winning a First or Second Prize will depend on the total number of eligible entries received for the applicable drawing. Prizes: One (1) Grand Prize: Trip for winner and one (1) guest to attend one (1) game of the 2013 NBA Finals. Trip prize includes: two (2) tickets to one (1) game of the 2013 NBA Finals, round-trip coach air transportation for two (2) from major U.S. gateway airport nearest Grand Prize winner's primary residence in the U.S., two (2)-night standard double-occupancy hotel accommodations (one (1) room) and ground transfers to/from the airport/hotel/game (all as selected in Sponsor's sole discretion). Approximate Retail Value ("ARV"): $3,000. Transportation to/from winner's primary residence and departing airport is not part of this prize package and is the sole responsibility of winner. Actual value of prize may vary depending on Grand Prize winner's city of departure, market conditions, changes in value of components (e.g., air transportation and hotel rates) and final itinerary. Travel, hotel, carrier and other arrangements to be determined by Sponsor in its sole discretion. Gratuities and incidental charges not included in hotel accommodations. Grand Prize winner and his/her guest must travel together on the same itinerary and are responsible for obtaining any/all necessary documents (including but not limited to valid photo I.D.) prior to departure. Other travel/accommodation restrictions may apply. Trip must be taken on dates designated by Sponsor, and Grand Prize winner must travel from a Sponsor-selected airport within the U.S. or prize will be forfeited in its entirety and an alternate Grand Prize winner may be randomly selected. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if Grand Prize winner lives within a reasonable driving distance of destination, as determined by Sponsor in its sole discretion, and to award no additional compensation or substitution for the difference in prize value in such event. Sponsor is not responsible for missed prize events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delays. Seat location at game will to be determined by Sponsor in its sole discretion. Specific travel arrangements and all prize details not specified herein will be made and determined in Sponsor's sole discretion. All transportation and event tickets are subject to the terms and conditions specified thereon. For round trip airfare, the departing airport must also be the airport that Grand Prize winner and his/her guest return to upon completion of the trip prize. Flight schedules are subject to change without notice. Grand Prize winner may be required to provide a credit card at time of hotel check-in to cover hotel incidentals. Grand Prize winner agrees that his/her guest must comply with Sponsor's and each prize provider's procedures and policies. Once selected by Grand Prize winner, guest cannot be changed without the express consent of Sponsor, which may be withheld for any reason. By entering this Sweepstakes and accepting the prize, the Grand Prize winner agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Sweepstakes- or prize-related activity, including, without limitation, attending the NBA Finals game. The Grand Prize winner understands and agrees that Sponsor or prize providers have the right, in their sole discretion, to disqualify and remove the Grand Prize winner or his/her guest from any activity at any time if the Grand Prize winner's or his/her guest's behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of Sponsor or otherwise violates the policies of the prize providers, and in such a case, the Grand Prize winner will still be solely responsible for all taxes and other expenses related to the prize. Participants waive the right to assert as a cost of winning any prize, any and all costs of verification and redemption or travel to claim the prize and any liability and publicity which might arise from claiming or seeking to claim said prize.
Four (4) First Prizes (one (1) prize per Voting Period): One (1) $150 NBA gift card redeemable at store.nba.com. Twenty (20) Second Prizes (five (5) prizes per Voting Period): One (1) Co-branded heavy-duty duffle bag. ARV: $30. Terms, conditions & restrictions on gift card may apply. All prize details, including details not specified in these Official Rules, are at Sponsor's sole discretion.
Total ARV of all prizes to be awarded in this Sweepstakes: $4,200.
Miscellaneous: Winners are responsible for any federal, state and local taxes, as well as any other costs and expenses associated with acceptance and use of prize not specified as covered as part of prize herein, including, without limitation, meals, luggage fees, in-room charges, gratuities, government charges, carrier fees and insurance for the Grand Prize. No transfer, assignment, cash redemption or substitution of prize (or portion of prize) is permitted, except by Sponsor or Presenter, which reserves the right to substitute a prize (or applicable portion of prize) with one of comparable or greater value, as determined by Sponsor or Presenter. Sponsor is not responsible for and winner will not receive the difference, if any, between the actual value of the prize at the time of award and the stated ARV in these Official Rules or in any Sweepstakes-related correspondence or materials. Sponsor will not replace any lost, mutilated or stolen prize or any prize that is undeliverable or does not reach the winner because of an incorrect or changed address or other contact information. If winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited and Sponsor will have no further obligation with respect to that prize or portion of the prize. No more than the stated prizes will be awarded. Potential winners may be required to prove eligibility, including, without limitation, proof of age, residence and identity, which may include submitting a copy of a driver's license, passport or similar government issued identification after being notified of being a potential winner. The potential Grand Prize winner will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within five (5) days of issuance of notification. A potential winner (or any alternate potential winner if one must be selected) is not official and shall not be confirmed as the winner until he/she has completed, signed and returned any documentation required by Sponsor. Grand Prize traveling companion must be of legal age of majority in his/her jurisdiction of residence (and at least eighteen (18) years of age) as of 4/24/13 (unless Grand Prize winner is the guest's parent or legal guardian) and will be required to sign and return a Liability Release and (where legal) Publicity Release prior to the issuance of travel documents. Non-compliance with any of the foregoing or these Official Rules, the inability to contact a potential winner within a reasonable time period, failure to return such documents within the specified time period, or the return of a prize or prize notification as undeliverable may result in disqualification and, time permitting, awarding of prize to an alternate winner, at Administrator's sole discretion, from among all remaining eligible entries received. By participating, entrants agree to be bound by these Official Rules and agree that: 1) Released Parties and their designees may use (unless prohibited by law) their name, voice, city/state of residence, photograph, biographical information and/or likeness for advertising and/or trade and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification, and 2) Released Parties and their designees and assigns shall have no liability and will be released, indemnified and held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize or participation (including any travel/activity related thereto) in this Sweepstakes. BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Released Parties' failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Sponsor reserves the right, in its sole discretion: 1) disqualify any person who tampers with the entry process, the operation of ESPN.com, or any other component of this Sweepstakes, or who is otherwise in violation of these Official Rules and 2) to modify, suspend or terminate this Sweepstakes (or any portion thereof) for any reason, as determined by Sponsor in its sole discretion, including, without limitation, if virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor, including but not limited to war or armed conflict (whether or not officially declared), labor controversy or threat thereof, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and, in the event of termination or suspension, at its discretion, randomly select winners for the drawing(s) at issue from among all eligible entries received as of the date of the event requiring such termination or suspension. CAUTION: Any attempt to damage or undermine the legitimate operation of this Sweepstakes is a violation of criminal & civil laws & should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys' fees) &/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
Sponsor reserves the right to conduct a background check of any and all records of the Grand Prize winner, including without limitation, civil and criminal court records and police reports. To the extent necessary under law, Grand Prize winner shall authorize this background check. Sponsor may also take all steps necessary to corroborate any information provided to Sponsor by Grand Prize winner in his/her interview. In that regard, Grand Prize winner will be obligated to provide necessary contacts and information so that Sponsor may conduct such investigation. Sponsor reserves the right (at its sole discretion) to disqualify Grand Prize winner from any prize element, based on the background check.
E-mail Change of Address Policy: It is the sole responsibility of the entrant to notify Sponsor if his or her e-mail address changes. To do so, click on the "myESPN" link on any ESPN.com page, then click on the Account Information link and follow the instructions.
Disputes/Choice of Law: Except where prohibited, each entrant agrees that: (i) all issues and questions concerning these Official Rules shall be governed by New York law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and (B) filed only in the state or federal courts situated in New York County, New York state, i.e., Manhattan, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Privacy: Personally identifiable information that is submitted by entrants as part of this Sweepstakes will be used to administer the Sweepstakes, select the prize winners and fulfill the prizes, and will be treated in accordance with Sponsor's privacy policy accessible on its website at www.ESPN.com. If entrants consent to receive promotional communications from Presenter (which is not required for entrants to enter the Sweepstakes), Sponsor will share consenting entrants' personal information with Presenter for the purpose of Presenter (and/or Presenter's dealers and affiliates) sending promotional communications to such consenting entrants.
