Eligibility: The Diet DEW Fuel the Frenzy Sweepstakes ("Sweepstakes") is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees, officers, directors, agents and representatives of ESPN Internet Ventures ("Sponsor"), Pepsi-Cola Company ("Presenter"), Project Support Team, Inc. ("P/S/T" and/or "Administrator"), Young America Corporation and each of their respective parent companies, subsidiaries, affiliates, advertising/promotion/fulfillment agencies, anyone else connected with the production and distribution of this Sweepstakes (hereafter "Released Parties") and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in their same household, whether or not related, are not eligible to enter or win. Sweepstakes is void where prohibited by law. To enter the Sweepstakes, entrant must be a member of ESPN.com or one of our family of sites (e.g., ABC.com, ABCNEWS.com, Disney Online, ESPNRISE.com and Family.com). Registration is free. If entrant is not a member, entrant may register by clicking on the link as indicated on the Sweepstakes entry page and following the instructions. Entrant may be asked to provide his or her name, physical address, email address, telephone number, birth date, gender and to select a password. Entrant may also be asked to consent to receive promotional emails. Consenting to receive promotional emails is optional and does not have to be agreed to in order to become a member or to win a prize. As a member, entrant may enter the Sweepstakes by logging in to the system with entrant's current username and password. Entrant may then be asked to answer survey questions or to consent to receive promotional emails from the Sponsor. Answering survey questions or consenting to receive promotional emails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes or to win a prize. Entrants are responsible for insuring that all contact information is up-to-date and accurate.
To Obtain an Entry Code: You may obtain an entry code needed to participate in the Sweepstakes (as outlined below), in one of two (2) ways: 1) Purchase any specially-marked Diet DEW® product between 1/30/12 and 4/8/12 (or while supplies last); or 2) To obtain an entry code and Official Rules without making a purchase, send a self-addressed stamped envelope (VT residents may omit return stamp) to be received by 4/12/12 to: Fuel the Frenzy Code Request, P.O. Box 16137, Bridgeport, CT 06673-6137. Limit one entry code request per stamped outer mailing envelope, mailed separately. Entry codes that are fraudulent, tampered with or obtained through unauthorized channels including but not limited to blogs will be void.
To Participate: Consumers will be eligible to participate between 12:00PM (noon) Eastern Time ("ET") on 1/30/12 and 11:59PM ET on 4/19/12 (the "Promotion Period") when they visit www.espn.com/dietdew, complete the member sign-in and fully complete and submit the online entry form in accordance with the instructions provided. Entrants must fully complete and submit all non-optional information requested on the online entry form to be eligible. Incomplete and inaccurate entries are void. The name of the "authorized account holder" associated with any given email address will be deemed to be the entrant and must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, an online service provider, or another organization that is responsible for assigning e-mail addresses or the domain associated with the submitted email address. Proof (to Sponsor's satisfaction) of being the authorized account holder may be required by Sponsor.
Released Parties are not responsible for lost, incomplete, late, damaged, inaccurate, incomplete, misdirected, delayed, stolen, garbled or undelivered entries, or transmissions, failures or malfunctions of phones, phone lines or telephone systems; any error, omission, interruption, defect or delay in any transmission, processing, or communication; interrupted or unavailable network, cable, satellite, Internet Service Provider (ISP), wireless, server or other connections including those through and/or by www.espn.com; miscommunications, failed computer hardware or software or technical failures; lost, non-delivery; misdirected, blocked, or delayed email notifications; garbled, misrouted or scrambled transmissions; printing, typographical or other errors appearing within these Official Rules, in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, telephone, electronic, mail or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries and/or the announcement of the prizes. The use of script, macro, automated entry, mechanical or similar devices or other any other devices that subvert the entry process to participate is prohibited and all entries through such devices are void. By entering this Sweepstakes, each entrant gives their express permission to be contacted by the Sponsor and/or Administrator by email, telephone, overnight delivery and/or mail for Sweepstakes purposes only.
Grand Prize Winner Selection: One (1) Grand Prize winner will be selected in a random drawing conducted on or about 4/25/12 from among all eligible entries received by Administrator, an independent judging organization whose decisions will be final and binding in all matters relating to this Sweepstakes. Odds of winning the Grand Prize will depend on the number of eligible entries received during the Promotion Period. Winner will be notified by telephone, overnight delivery and/or mail in Sponsor's sole discretion.
Weekly Prize Winner Selection: Potential Weekly Prize winners will be selected in (34,560) individual random drawings (one (1) drawing will be conducted per minute for each Weekend Drawing Date of the Promotion Period to select a total of (4,320) winners per Entry Period). Each Entry Period listed above will begin at 12:00AM ET and conclude at 11:59PM ET, with the exception of the first week which will begin at 12:00PM (noon) ET. Non-winning entries received for any given Entry Period will not carry forward to or be included in subsequent Entry Periods. Drawings will be conducted by Sponsor. Odds of winning a Weekly Prize will depend on the number of eligible entries received during the applicable Weekly Entry Period. Potential winners will be notified by email, telephone, overnight delivery and/or mail.
Prizes: One (1) Grand Prize: Trip for winner plus one (1) guest to Bristol, CT to attend a tour of ESPN Studios. Trip includes round trip coach air transportation for two (2) from major U.S. gateway airport nearest winner's primary residence in the U.S., 2-night standard double occupancy hotel accommodations (one (1) room) & ground transfers to/from the airport/hotel/studio. Approximate Retail Value ("ARV"): $2,000. Actual value of Grand Prize may vary depending on winner's city of departure. If the actual value of prize is less than the stated ARV, the difference will not be awarded. Travel, hotel and other arrangements to be determined by Sponsor, in its sole discretion. Winner and his/her guest must travel together on the same itinerary and are responsible for obtaining any/all necessary documents (including but not limited to valid photo I.D.) prior to departure. If Grand Prize winner chooses not to take a guest, then the guest elements will be forfeited and the remaining elements shall constitute full satisfaction of the Grand Prize. Other travel/accommodation restrictions may apply. Trip must be taken on dates and times designated by Sponsor or prize will be forfeited in its entirety and may be awarded to an alternate winner. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if a winner lives within a reasonable driving distance of destination, as determined by Sponsor in its sole discretion, and to award no additional compensation in such event. Miscellaneous: Winners are responsible for income, federal, state and local taxes, as well as any other costs and expenses associated with acceptance and use of prize not specified as covered as part of prize herein, including, without limitation, meals, luggage fees, gratuities and insurance for Grand Prize winner. No transfer, assignment, cash redemption or substitution of a prize (or portion of prize) except by Sponsor due to prize unavailability and then for a prize (or applicable portion of prize) of equal or greater value as determined by Sponsor. Winners receiving a prize valued at $600 or greater will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within five (5) days of issuance of notification. Grand Prize winner's guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18) unless child or legal ward of winner. Grand Prize winner's guest (if minor child or legal ward of winner, winner on his/her behalf) may also be required to sign and return a Liability Release and (where legal) Publicity Release prior to the issuance of travel documents. Non-compliance with the foregoing may result in disqualification and awarding of prize to an alternate winner. If any prize notification letter or prize is returned as undeliverable, potential winner will be disqualified and an alternate winner may be selected. Designation of Grand Prize winner is subject to verification of the Affidavit/Release. By participating, entrants agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees may use (unless prohibited by law) their name, voice, city/state of residence, photograph and/or likeness for advertising and/or trade and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification, and 2.) Released Parties and their designees and assigns shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate this Sweepstakes (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor, including but not limited to war or armed conflict (whether or not officially declared), labor controversy or threat thereof, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and, in the event of termination or suspension, at its discretion, select winners for the drawing at issue from among all eligible, non-suspect entries received as of the date of the event requiring such termination or suspension.
Sponsor reserves the right to conduct a background check of any and all records of the Grand Prize winner, including without limitation, civil and criminal court records and police reports. To the extent necessary under law, Grand Prize winner shall authorize this background check. Sponsor may also take all steps necessary to corroborate any information provided to Sponsor by Grand Prize winner in his/her interview. In that regard, Grand Prize winner will be obligated to provide necessary contacts and information so that Sponsor may conduct such investigation. Sponsor reserves the right (at its sole discretion) to disqualify the Grand Prize winner from any prize element, based on the background check.
E-mail Change of Address Policy: It is the sole responsibility of the entrant to notify Sponsor if his or her e-mail address changes. To do so, click on the "myESPN" link on any ESPN.com page, then click on the Account Information link and follow the instructions.
Disputes/Choice of Law: Except where prohibited, each entrant agrees that: (i) all issues and questions concerning these Official Rules shall be governed by New York law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and (B) filed only in the state or federal courts situated in New York County, New York state, i.e., Manhattan, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Privacy: Personally identifiable information that is submitted by entrants as part of this Sweepstakes will be used to administer the Sweepstakes, select the prize winners and fulfill the prizes, and will be treated in accordance with Sponsor's privacy policy, accessible on their website at www.espn.com.
