Eligibility: The Chick-fil-A Mascot Movers Sweepstakes ("Sweepstakes") is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older as of 9/29/08. Employees, officers, directors, agents, and representatives of ESPN/Starwave Partners d/b/a ESPN Internet Venture ("Sponsor"), Chick-fil-A, Inc. ("Presenter"), CFA Properties, Inc., and Chick-fil-A, Dwarf HouseR, and Truett's GrillR restaurants, and each of their respective parent companies, subsidiaries, affiliates, advertising/promotion/fulfillment agencies, anyone else connected with the production and distribution of this Sweepstakes, and Project Support Team, Inc. ("Administrator") (hereafter, collectively "Released Parties") and their immediate families (spouse, parent(s), child(ren), sibling(s), and their respective spouses, regardless of where they reside) and those living in their same household, whether or not related, are not eligible to enter or win. To enter the Sweepstakes, entrant must be a member of ESPN.com or one of ESPN's family of sites (ABC.com, ABCNEWS.com, Disney Online, EXPN.com, Family.com, and Movies.com) (hereafter, collectively "Sites"). Registration on the Sites is free. If entrant is not a member of one of the Sites, entrant may register by clicking on the link as indicated on the Sweepstakes entry page and following the instructions. Entrant will be asked to provide his or her name, address, e-mail address, telephone number, birth date, gender and to select a password. Entrant will also be asked to consent to receive promotional e-mails. Consenting to receive promotional e-mails is optional and does not have to be agreed to in order to become a member or Sweepstakes entrant or to win a prize. As a member, entrant may enter the Sweepstakes by first logging in to the system with entrant's current username and password. Entrant may then be asked to answer survey questions or to consent to receive promotional e-mails or other correspondence from Sponsor, Presenter, or their designees. Answering survey questions or consenting to receive promotional e-mails or other correspondence is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes or to win a prize. Entrants are responsible for insuring that all contact information is up-to-date and accurate.
How To Participate: Visit www.ESPN.com between 1:00:00PM Eastern Time ("ET") on 9/29/08 and 11:59:59PM ET on 12/6/08 ("Sweepstakes Period"), search for keyword "Chick-fil-A," (and any variations in the spelling of this word) and follow the instructions provided to answer up to three (3) College Football themed questions (Weekly Poll Question, Mascot Mover Question, or Game Day Pick Question) to receive one (1) entry total for any question answered. Answering any question correctly is not required for entry in the Sweepstakes and does not increase entrant's chance of winning. For the purpose of the Sweepstakes, each week will begin on a Tuesday at 10:00:00AM ET and conclude on the following Saturday at 11:59:59PM ET, with the exception of the first week, which will begin on a Monday (9/29/08 at 1:00:00PM ET). There is a limit of one (1) entry in the prize drawing per person, per mailing address, and per valid e-mail address per week for the duration of the Sweepstakes Period. Submission of multiple entries per week may result in entrant's ineligibility. All entries must be received in the manner described in these Official Rules during the Sweepstakes Period to be eligible for prizes. The name of the "authorized account holder" associated with any given e-mail address will be deemed to be the entrant, who must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, an online service provider, or another organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Proof (to Sponsor's satisfaction) of being the authorized account holder may be required by Sponsor. Neither Sponsor nor Released Parties are responsible for lost, incomplete, late, damaged, or misdirected entries or e-mail messages; failures or malfunctions of phones, phone lines or telephone systems or other communications malfunctions; interrupted or unavailable network, server or other connections including those through www.espn.com; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrant's or any other person's computer related to or resulting from participation in this Sweepstakes; printing or other errors appearing within these Official Rules or in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic, or otherwise. The use of automated entry or similar devices as specifically set forth above is prohibited, and entries through such prohibited devices are void. By entering this Sweepstakes, entrants give their express permission to be contacted by Sponsor, Presenter, or their designees by telephone, e-mail, and/or postal mail for Sweepstakes purposes only.
Winner Selection: Weekly winners will be selected in ten (10) individual random drawings conducted on or about 12/9/08 from among all eligible entries received for each week of the Sweepstakes Period. Entries received for one (1) weekly drawing will not carry forward to or be included in subsequent drawings. Winners do not have to be present at the drawings to win. Winning entries are subject to verification by Sponsor or its designee. Sponsor or its designee will attempt to notify each winner of his/her winning status via the telephone number(s), e-mail address, or mailing address provided on winner's entry form. Before a prize is awarded to a winner, that winner must complete, sign, and return an Affidavit of Eligibility ("Affidavit") and, where lawful, Liability/Publicity Release ("Release") (collectively, "Affidavit and Release") within three (3) days after notification. If any prize notification letter or prize is returned as undeliverable, winner will be disqualified, and an alternate winner may be selected for the drawing at issue. If the indicated forms are not signed and returned by the time indicated on the documents, or if a winner does not meet eligibility criteria, or is otherwise unwilling or unable to comply with these Official Rules, an alternate winner may be selected.
Sponsor reserves the right to conduct a background check of any and all records of any Weekly Prize winner, including without limitation, civil and criminal court records and police reports. To the extent necessary under law, Weekly Prize winners shall authorize this background check. Sponsor may also take all steps necessary to corroborate any information provided to Sponsor by any Weekly Prize winner. In that regard, Weekly Prize winners will be obligated to provide necessary contacts and information so that Sponsor may conduct such investigation. Sponsor reserves the right (at its sole discretion) to disqualify any Weekly Prize winner from any prize element, based on the background check.
Odds of Winning: Odds of winning a prize will depend on the total number of eligible entries received for the applicable weekly drawing. Limit one (1) Weekly Prize per person, family, or household.
Prizes: Ten (10) Weekly Prizes, each consisting of a trip for winner plus one (1) guest to the 2008 Chick-fil-A Bowl in Atlanta, Georgia, tentatively scheduled for December 31, 2008. Trip includes round-trip coach air transportation for two (2) from major U.S. airport nearest winner's primary residence in the U.S. to Atlanta, Georgia, two (2) nights (standard, double-occupancy) hotel accommodations, ground transfers to/from the airport/hotel/ Chick-fil-A Bowl, (2) tickets to the Chick-fil-A MVP Tailgate Party, (2) tickets to the Chick-fil-A Fan Fest, tour of the ESPN Production Compound and admission for winner and one (1) guest to the 2008 Chick-fil-A Bowl Game. In addition, each winner will receive free Chick-fil-A food for one (1) year (consisting of fifty-two (52) coupons, each valid for one (1) Chick-fil-A Combo Meal, redeemable at participating Chick-fil-A restaurants) Approximate Retail Value ("ARV") of each prize is $2,183.Total ARV of all prizes is $21,830. In the event that the Chick-fil-A Bowl Game is cancelled or preempted for any reason, no substitution of that portion of the prize will be provided. Guest of winner must travel with winner on same itinerary, and shall be required (or, if a minor, his/her parent/legal guardian shall be required) to sign and return a travel companion release and release of liability/publicity prior to issuance of travel documents (Tennessee residents need not complete the publicity release). Any minor traveling with a winner must be accompanied at all times by their parent/legal guardian. Travel arrangements shall be through Sponsor's agent, on a carrier of Sponsor's choice. Certain restrictions/blackout dates may apply, and travel is subject to applicable provider's terms and conditions. Trip may not be combined with any other offer, and travel may not qualify for frequent flyer miles or other similar credits or benefits. ARV may vary based on location of winner's primary residence. All other expenses not specifically mentioned herein, including but not limited to taxes and meals, are the sole responsibility of each winner and/or guest of winner.
General Release and Waiver of Claims: By entering this Sweepstakes and/or accepting a prize, each entrant and/or winner (for himself or herself and his or her heirs) hereby releases the Released Parties and their designees and assigns from: (i) any and all liability, loss, harm, damage, cost, or expense associated with the entrant or winner's participation in this Sweepstakes, redemption of any prize in connection with this Sweepstakes, attendance at any events related to this Sweepstakes, and/or use or misuse of any prize in connection with this Sweepstakes, including, but not limited to, all reasonable counsel fees and court costs incurred, property damage, personal injury, and/or death; (ii) anything related to the production, promotion, or execution of this Sweepstakes (or participation therein), including preemption, cancellation, or rescheduling of the 2008 Chick-fil-A Bowl Game; and (iii) anything that may occur in connection with acceptance and/or use of the prizes or while participating in or traveling to any prize-related activity, even if caused or contributed to by the negligence of Releasees.
General Conditions: Sponsor reserves the right, at its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. If for any reason the Sweepstakes is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, actions by entrants, fraud, or any other causes which, Sponsor in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, or the Sweepstakes is otherwise not capable of running as planned, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes. If such malfunction, error, disruption, or damage occurs, and it impairs the administration, security, fairness, integrity, or proper play of the Sweepstakes, Sponsor may, in its sole discretion, suspend or terminate the Sweepstakes or any portion thereof by posting a notice at . If the Sweepstakes or any portion of the Sweepstakes is terminated before the end of the Sweepstakes Period, Sponsor will select winners for the drawing at issue from among eligible, non-suspect entries received as of the date of the event requiring such termination or suspension. In the event that a prize cannot be awarded for any reason, Sponsor shall not be obligated to award any prize, and Sponsor reserves the right, in its sole discretion, whether or not to substitute prize (or portion of prize) with a prize of comparable or greater value or cash value. Non-compliance with these Official Rules may result in disqualification. An individual is not a winner until he or she has fully complied with these Official Rules.
LIMITATIONS OF LIABILITY. IN NO EVENT WILL SPONSOR OR ANY RELEASED PARTY BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, CLAIMS, ACTIONS, DAMAGES, LOSSES, OR LIABILITY OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM OR ARISING FROM PARTICIPATION IN, OR THE PRODUCTION, PROMOTION, OR ADMINISTRATION OF, THE SWEEPSTAKES, OR ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF A PRIZE THAT MAY BE AWARDED. WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Miscellaneous: Non-compliance with these Official Rules shall result in disqualification from the Sweepstakes. No transfer, assignment, cash redemption, or substitution of prizes (or portion of prize) is permitted except by Sponsor due to prize unavailability and then for a prize (or applicable portion of prize) of equal or greater value as determined by Sponsor. Non-compliance with the foregoing may result in disqualification and awarding of prize to an alternate winner for the drawing at issue. All drawings will be conducted by Administrator, an independent judging organization whose decisions are final and binding in all matters relating to this Sweepstakes. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions or interpretations of Sponsor regarding the Official Rules, which are final and binding in all respects and agree (for himself or herself and his or her heirs) that Released Parties and their designees may use (unless prohibited by law) their name, voice, city/state of residence, photograph, and/or likeness for advertising and/or trade and/or for any other purpose in any media or format now or hereafter known without further compensation, permission, or notification.
Non-Waiver: The failure or delay by Sponsor in enforcing any particular clause, provision, or aspect of these Official Rules shall not impact the validity, enforceability, or effect of any other clause, provision or aspect of these Official Rules.
E-mail Change of Address Policy: It is the sole responsibility of the entrant to notify Sponsor if his or her e-mail address changes. To do so, click on the "Help" link at the bottom of any ESPN.com web page, then click on the "Change Personal Information" link and follow the instructions.
Disputes/Choice of Law: Except where prohibited, each entrant agrees that: (i) all issues and questions concerning these Official Rules shall be governed by New York law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims, and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded shall be: (A) resolved individually, without resort to any form of class action; and (B) filed only in the state or federal courts situated in New York County, New York state, i.e., Manhattan, and each entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims, or causes of action; (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, and/or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Privacy: Personally identifiable information that is submitted by entrants as part of this Sweepstakes will be used to administer the Sweepstakes, select the prize winners, and fulfill the prizes, and will be treated in accordance with Sponsor's privacy policy accessible on its website at .
